The following are the terms and conditions (the "Terms and Conditions") under which you may use jobescalator.com (the "Web Site"). The Web Site is owned and run by the Chartered Society of Physiotherapy (the “CSP”). CSP has set up the Web Site under the operating name “Jobescalator” and all references in these Terms and Conditions to “Jobescalator” include a reference to the CSP. Please ensure that you read these Terms and Conditions carefully. Your continued use of the Web Site indicates your agreement to be legally bound by these Terms and Conditions. If you do not agree with these Terms and Conditions and do not wish to be bound by them please exit the Web Site and refrain from using it in the future.

These Terms and Conditions should be read in conjunction with the Jobescalator Privacy Policy that forms part of these Terms and Conditions.

1 USE OF THE WEB SITE

Jobescalator authorises you to access, view, copy, print, download, transmit and store (for the purposes expressly permitted in these Terms and Conditions only) the contents of the Web Site (the "Web Site Content") for your own personal use provided that you do not:

Jobescalator reserves the right, at its sole discretion, to treat any contravention of these Terms and Conditions by you as a material breach and shall be entitled to terminate these Terms and Conditions, block your access to the Web Site and remove any information posted by you on the Web Site without further notice to you.

3 JOBESCALATOR'S LIABILITY

The Web Site is provided to you by Jobescalator on an "as is" and "as and when available" basis. Access to and use of the Web Site is at your own risk.

Jobescalator makes no representation or warranty that the Web Site or services offered via the Web Site will be accessible, useable by you or error free.

The Web Site is a host for employers to post employment opportunities to which candidates may respond with their personal information. Jobescalator is not involved in the dealings between the users of the Web Site and generally does not screen the information provided by users. Jobescalator does not guarantee the accuracy or reliability of information posted by users neither does it endorse the opinions expressed by users.

5 USER OBLIGATIONS

6 ACKNOWLEDGEMENTS, WARRANTIES AND REPRESENTATIONS

By accessing and/or using the Web Site you acknowledge that:

  • you are responsible for the accuracy or otherwise of the information or data posted by you on the Web Site
  • no proprietary right accrues to you in any software, information, material or methods supplied by Jobescalator
  • you have not relied upon any warranty representation or assurance which may have been given by Jobescalator as to the success of the Jobescalator site
  • Jobescalator may alter or delete Candidate Information at any time without prior notice, anonymous Candidate information will be stored by Jobescalator for up to six years in compliance with the Data Protection Act 1998.

7 INDEMNITY

You agree to defend and indemnify Jobescalator, its officers, employees and agents from and against all actions, claims or demands brought against Jobescalator arising from the Web Site Content that you use, any information you provide to Jobescalator and/or any breach by you of these Terms and Conditions.

8 VARIATION OF TERMS AND CONDITIONS

Jobescalator may vary these Terms and Conditions in its sole discretion at any time without your prior consent. Any changes to the Terms and Conditions will come into effect once posted by Jobescalator on the Web Site. Your continued use of the Web Site will be deemed to indicate your acceptance of any variations to these Terms and Conditions. If you do not agree with the varied Terms and Conditions and do not wish to be bound by them please exit the Web Site and refrain from using it in the future. No variation by you of the Terms and Conditions will be valid.

Jobescalator retains all ownership, title and interest in the intellectual property rights contained in the Web Site content including but not limited to copyright, database rights, trade marks, patents, service marks, design rights (whether registerable or otherwise) know-how, trade or business names, domain names, goodwill associated with any of the foregoing and other similar rights or obligations whether registerable or not in any jurisdiction in the world.

Jobescalator and the Jobescalator logo are trademarks or registered trademarks of Jobescalator. All other product names and company logos mentioned in the information, documents or other items provided or available herein may be the trademarks of their respective owners.

11 GOVERNING LAW, JURISDICTION AND REPRESENTATION

These Terms and Conditions are governed by the laws of England and Wales and are subject to the exclusive jurisdiction of the courts of England and Wales (the "Jurisdiction"). Jobescalator makes no representation that the contents of the Web Site may be lawfully viewed or downloaded outside the Jurisdiction. If you access the Web Site outside of the Jurisdiction you do so at your own risk and will be responsible for complying with any local laws or regulations.

12 GENERAL

If any part of these Terms and Conditions are held by a court of competent jurisdiction to be unenforceable, the validity of the remainder of these Terms and Conditions will not be affected.

These Terms and Conditions do not affect any consumer rights that you may have under the provisions of any applicable law or regulation.

These Terms and Conditions constitute the entire agreement between you and Jobescalator in relation to your access to or use of the Web Site.

The Web Site is owned and run by the Chartered Society of Physiotherapy (the "CSP") which is committed to protecting your privacy in accordance with its obligations under the Data Protection Act 1998. This Privacy Policy explains what information the CSP collects about you through your use of the Web Site and how it will be used. All references in this Privacy Policy to Jobescalator include a reference to the CSP. When you access and use this Web Site you agree to be legally bound by the Terms and Conditions as well as by this Privacy Policy.

What information do we collect?
Jobescalator collects information from you to enable us to provide you with services you ask for. This may include your name, address, telephone, email address, credit or other payment card details.

Jobescalator collects email addresses as part of the registration process. These email addresses are held primarily to provide password confirmation when members have forgotten their passwords.

Jobescalator may also use these email addresses to invite you to receive future email communications. You will be given the option of opting out of receiving these emails when the invitation is first made. Jobescalator will not use these email addresses for other purposes or pass them on to third parties except where indicated in this Privacy Policy.
